Hassan was celebrating the end of a religious fasting period and had too much to drink. Unwisely, he drove home and was pulled over by police because he was weaving between lanes. He blew almost twice the legal limit. At a pre-trial motion, the breath samples were excluded from evidence because Hassan, as a recent immigrant, did not speak English well. The police failed to provide him with an interpreter so that he could understand his rights. This was a violation of his rights under the Charter of Rights. Because the breath samples were excluded, Hassan was found Not Guilty.Back
