Enzo was leaving a nightclub when he was pulled over by police. He failed a roadside screening test and was found to be “over 80”. We requested the maintenance records for the Intoxilyzer machine used to take the breath samples. The Crown opposed our request and we successfully litigated the issue, despite many legal obstacles and other tactics used by the Crown to deny us. As a result of this, the charges were thrown out by the court because of the delay caused by the Crown’s refusal to provide disclosure. This delay was a violation of Enzo’s right to be tried within a reasonable time under the Charter of Rights, and he was found Not Guilty.Back
